AGENDIZED, PART II: Organic Waste, Building Codes and Emergency Declarations in Fortuna
If the Eureka City Council meeting tonight is quiet, the Fortuna meeting is even more so. There are only two non-consensual calendar items to address, both of which are fairly routine things that every local government does these days: update building codes to comply with new state laws and to maintain them. d. Edible food collection community participation
The City of Fortuna is working to comply with California Senate Bill 1383. The bill requires cities to reduce organic waste to prevent pollution. To do this, the city needs to develop an edible food take-back program. Humboldt County Public Works has agreed to lead if Humboldt County Public Works receives the cost of the program and an assurance from the City to participate in the development. The consent form asks the city council to authorize the mayor to sign a letter to Humboldt County promising to participate in the program. This would allow the city to avoid his $10,000 per day fine for not meeting SB 1383 requirements. The City will be required to pay a share of the program costs of approximately $11,000.

The City of Fortuna is proposing to amend its organic waste disposal ordinance to comply with a state law known as SB 1383. The law sets goals to reduce the amount of organic waste that ends up in landfills, and also sets goals to save edible food. and deliver to those in need. The City needs to change its waste collection and recycling program to meet the requirements of SB 1383, and the City Council is holding public hearings and a second reading of the ordinance to implement the changes.

b. Public Hearings: First Readings to Consider, Title 15, Abolition and Replacement of Building and Construction. Division I, General.Section 15.10, Building Codes Per California Building Code 2022 Mandated by California Building Code Board and Department of Housing and Community Development, Ordinance 2023-758
The ordinance proposes that the City of Fortuna repeal its current building code and replace it with the 2022 California Building Code. It also proposes several regional amendments to the Code, including permit expiration dates, commercial building engineering requirements, and boundary and topographic survey requirements. The ordinance also sets penalties for violations of the code and fees for work done without proper permits.

Fortuna’s mayor and city council were concerned about the city’s aging infrastructure and the potential for accidents should it fail. The city has been a leader in technological progress, so the decision was made to update the city’s Building and Construction Code to the latest California Building Code, and Ordinance 2023-758 was drafted. The mayor and city council held hearings to consider scrapping the existing ordinance and replacing it with a new ordinance.
The hearing was well attended by citizens, engineers, contractors and architects. After thorough discussion, the city council approved the proposed ordinance, with the exception of a few administrative amendments. Amendments included establishing conditions and procedures for revocation of permits, commercial building engineering permitting exemption by builder, waiver of property inspection by builder, and penalties for violations.
The updated code was implemented on January 1, 2023, and the effects were immediately noticeable. Cities’ infrastructure was much more efficient and resilient, and citizens were happy. influxed.
Unfortunately, the city’s new prosperity did not last long. Just one month later, a mysterious force descended on the city, rendering updated building codes useless.
